1. Agreement to Terms

By accessing or using the WiSee Platform ("Service"), including our fleet management software, AI dashcam systems, GPS tracking, and related services, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

WiSee Platform provides a comprehensive fleet management solution including:

• Real-time GPS and indoor tracking (NRLS, BLE, LoRa technologies)
• AI-powered dashcam with live video streaming
• Built-in 4G LTE connectivity
• Advanced analytics and reporting
• Geofencing and alert systems
• Multi-user collaboration tools
• API access for integrations

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts. By registering, you represent that you have the authority to bind the entity you represent.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized use
• Ensuring your account information is accurate and current

4. Video Recording Consent

4.1 Recording Notice

By using our AI dashcam services, you acknowledge and agree that:

• Video and audio may be recorded inside and outside vehicles
• You have obtained all necessary consents from drivers and passengers
• You will comply with all applicable recording laws in your jurisdiction
• You are responsible for posting appropriate notices in vehicles

4.2 Use of Recordings

Video recordings may be used for:

• Safety monitoring and incident investigation
• Driver training and performance improvement
• Insurance claims and legal proceedings
• AI model training (with anonymization)

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on privacy rights of individuals
• Harass, stalk, or monitor individuals illegally
• Transmit malicious code or interfere with the Service
• Attempt to gain unauthorized access to any systems
• Resell or redistribute the Service without permission
• Use the Service for any unlawful or harmful purpose

6. Intellectual Property

All content, features, and functionality of the Service are owned by WiSee Platform and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7. Payment Terms

7.1 Fees

You agree to pay all fees associated with your subscription plan. Fees are non-refundable except as required by law or as explicitly stated in these Terms.

7.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. We reserve the right to change our fees with 30 days' notice.

8. Service Level Agreement

We strive to maintain 99.9% uptime for our Service. In the event of downtime exceeding our SLA, you may be eligible for service credits as outlined in our separate SLA document.

9. Data Ownership

You retain all rights to your data. We claim no ownership over the content you upload or generate through the Service. You grant us a limited license to use your data solely to provide and improve our services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISEE PLATFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

11. Indemnification

You agree to indemnify and hold harmless WiSee Platform from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

Either party may terminate these Terms at any time with written notice. Upon termination, your access to the Service will cease immediately. Provisions that should survive termination will remain in effect.

13. Governing Law

These Terms shall be governed by the laws of Australia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Victoria, Australia.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use constitutes acceptance of the modified Terms.

15. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and WiSee Platform
• Severability: If any provision is found unenforceable, the remaining provisions shall continue in effect
• Waiver: No waiver shall be effective unless in writing
• Assignment: You may not assign these Terms without our written consent
